1. Agreement to Terms

By accessing or using Global City Time ("the Service," "our Site," or "we"), available at globalcitytime.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and K-Software, the operator of Global City Time.

Global City Time provides a free online service that offers:

• Current time information for major cities worldwide
• Time zone information and conversions
• Search functionality for finding time information by city name
• Related time and date information
• Some weather and astronomical data for major cities worldwide

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include any right to:

The Service is supported by advertising. By using the Service, you acknowledge and agree that:

• We are not responsible for the content of advertisements or the practices of third-party advertisers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, K-SOFTWARE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or inability to access the Service
• Damages resulting from any conduct or content of any third party on the Service
• Damages resulting from unauthorized access, use, or alteration of your transmissions or content
• Damages resulting from reliance on time information provided by the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED ONE HUNDRED EUROS (€100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless K-Software, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of any rights of another person or entity
• Any content you submit or transmit through the Service

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Kraków, Poland. However, we retain the right to bring legal proceedings in any jurisdiction where you reside or where a breach of these Terms occurs.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Waiver

No waiver by K-Software of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by K-Software to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and K-Software concerning the Service and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter hereof.
